On 19 May 2026, the Tribunal Supremo (Spain's Supreme Court) struck down the Registro Único de Arrendamientos de Corta Duración (the NRUA, Spain's single national register for short-term lets), the centrepiece of Real Decreto 1312/2024, which over the past year forced thousands of owners to obtain a national registration number before listing their home on Airbnb, Booking or any platform with a booking engine. If you own or manage a holiday let, this is what really changes, and what stays exactly the same.

What has the Supreme Court decided?

In judgment 620/2026, the Supreme Court's Contentious-Administrative Chamber partially upheld the appeal lodged against Real Decreto 1312/2024 and struck down the procedure for registering in the national Registro Único. The reason: central government has no power to create a national register that overlaps with the regional tourism registers, a matter that belongs to the autonomous communities. It is the same reason why Madrid, Andalusia, Castile and León or Asturias have for years required their own licence or declaración responsable (sworn statement), regardless of what central government decides.

What is struck down and what still applies

The judgment does not overturn the whole regulation, only the part where central government overstepped its powers:

  • Struck down: the obligation to apply for the national Número de Registro Único (NRUA) to list your home.
  • Still applies: the Ventanilla Única Digital (single digital window) for lets.
  • Still applies: the obligation for platforms (Airbnb, Booking, Vrbo…) to pass data on to the authorities.
  • Unchanged: your regional holiday-let licence or tourism registration, the same one that existed before the NRUA was created.

So I no longer need any registration to let on Airbnb or Booking?

That is not what the judgment says, and it is the most dangerous misunderstanding that can come out of this news. The only thing that disappears is the extra layer that central government had added in 2025. Your autonomous community's holiday-let licence (the certificado de idoneidad in Madrid, the declaración responsable in Andalusia, registration in the Castile and León tourism register, etc.) is still exactly as compulsory as it was before July 2025. If you don't have it yet, see our complete guide to holiday-let licences by autonomous community to find out what you need to apply for in your region.

If you already obtained the NRUA, was it all for nothing?

The number you already obtained no longer has any effect, but there is no point trying to «cancel» it: the judgment simply makes it inapplicable. Some law firms are already looking into financial liability claims against the authorities for the costs of a procedure that a court has declared void. If you think your case fits, the sensible thing is to consult a specialist lawyer; it is not something this article alone can settle.

What to do now if you have, or are about to launch, a holiday let

  1. Don't apply for the NRUA: it is no longer a requirement, so you save yourself the paperwork and the wait.
  2. Check your regional licence: it is the only thing your community really requires. See the guide by autonomous community.
  3. If you can't get a holiday-let licence, consider mid-term lets as a legal alternative: from holiday let to mid-term let.
  4. Stay alert: autonomous communities and platforms are likely to adjust their processes over the coming months to adapt to the judgment.

Frequently asked questions

What exactly did the Supreme Court strike down?

The national Número de Registro Único (NRUA) created by Real Decreto 1312/2024, for encroaching on the autonomous communities' powers over tourism. The judgment keeps the Ventanilla Única Digital and the platforms' obligations to pass on data.

Do I still need a holiday-let licence to let on Airbnb or Booking?

Yes. The judgment only affects the additional national register; the regional licence or registration, the one that existed before July 2025, is still compulsory in every community.

What happens to the registration number I already obtained?

It no longer has any effect because the regulation that created it has been struck down. You don't need to do anything to cancel it; if you want to consider a claim for the costs of the procedure, consult a specialist lawyer.
